Abstract/Citation
The purpose of this Act is to—
(a) provide clear powers for the enforcement of New Zealand’s criminal law in international waters; and
(b) uphold New Zealand’s rights and obligations under international law, particularly the United Nations Convention on the Law of the Sea, consistent with international human rights law.
Includes power to detain and forfeit ship to the Crown if it arrives in New Zealand under a direction given under section 23(2)(b)(i) including the following:
- an offence against section 98 of the Crimes Act 1961 (which relates to dealing in slaves;
- an offence against section 98AA of the Crimes Act 1961 (which relates to dealing in people under 18 for sexual exploitation, removal of body parts, or engagement in forced labour);
- any offence against sections 98B to 98F of the Crimes Act 1961 (which relate to smuggling and trafficking in people).
