The purpose of this Act is to consolidate and reform labour law. Part II provides for labour administration, which continues to be entrusted to the Labour Department. Part III establishes the Labour Advisory Board, which is intended to serve as a forum for discussion between employers and trade unions. Part IV establishes an Industrial Tribunal for each Division of Gambia, with jurisdiction over claims arising out of contracts of employment. Part V provides for recruitment and hiring, and Part IV, for registration and training. Part VII covers conditions and contracts of employment, and Part VIII provides for the protection of wages. Part IX makes provisions that are almost entirely new in Gambia, notably by giving employees the right to complain before the Industrial Tribunal against wrongful dismissal, including in the event of dismissal during industrial action. Under Part X, the existing system of trade union registration is amended and adapted for employers' organisations. The new system comprises a mechanism designed to prevent employer-dominated trade unions from gaining undue advantages through sole bargaining agencies. Part XI covers industrial relations and maintains the bargaining role of the Joint Industrial Councils. The Employment Exchange and Registration of Employees Act (Cap. 61), the Labour Administration Act (Cap. 100), the Recruiting of Workers Act (Cap. 103), the Trade Unions Act (Cap. 106), the Wages Council Act (Cap. 186), the Wages Protection Act (Cap. 187), the Workers Employment Act (Cap. 195), and the Trade Union Amendment Act, 1976, are repealed. The date of entry into force of the Act is to be announced by the Minister by publication in the Gazette.
