Nearly all monies paid by an employer to claimants while in receipt of Unemployment Insurance (U.I.) benefits are earnings to be deducted from benefits payable. One exception to this rule is where they are paid through a Supplemental Unemployment Benefit (SUB) plan meeting the regulatory criteria of subsection 57(13) of the U.I. Regulations. These amendments enable the employer to provide a supplement to U.I. benefits for maternity and parental leaves without the need to be included in the formal regulatory criteria for approving a SUB plan.
